Complaints filed by RSB Spine

On December 13, 2018, RSB Spine, LLC (“Plaintiff”) filed complaints in Delaware against Life Spine, Inc. (1:18-cv-01972 (D. Del.)); Medacta USA, Inc. (1:18-cv-01973 (D. Del.)); Precision Spine Inc. (1:18-cv-01974 (D. Del.)); RTI Surgical, Inc. (1:18-cv-01975 (D. Del.)); and Xtant Medical Holdings, Inc. (1:18-cv-01976 (D. Del.)) (“Defendants”) for infringement of U.S. Patent Nos. 6,984,234 (“the ‘234 Patent”) and 9,713,537 (“the ‘537 Patent”). The complaints against Life Spine, Precision Spine, and RTI Surgical also allege infringement of U.S. Patent No. 6,235,034 (“the ‘034 Patent”). The ‘234, ‘537, and ‘034 Patents are assigned to the Plaintiff and are drawn to medical stabilization devices used to repair or alleviate injuries to the spine.

The Plaintiff is asserting that the Defendants are directly and indirectly infringing the ‘234, ‘537, and ‘034 Patents by making, selling, offering to sell, and/or using their systems, including Life Spine’s Presidio® Anterior Lumbar Fixation System, Gruve Anterior Cervical Plate System, Kinetic Dynamic Anterior Cervical Plate System, Neo Anterior Cervical Plate System, Sentry™ Anterior Lumbar Fixation System, Sentry™ 4 Lateral Plate System, Dyna-Link® Stand-Alone Anterior Lumbar System, Pro-Link® Stand-Alone Cervical Spacer System®, and PRO-LINK® Ti Titanium Stand-Alone Cervical Spacer System; Medacta’s MectaLIF Anterior Stand Alone – Flush; Precision Spine’s Slimplicity® Anterior Cervical Plating System, Slimplicity® Solo Anterior Cervical Plate System, AccuFit® ALIF Plate System, AccuFit Lateral Plate System, Vault® ALIF System, Vault® C ACDF System, Vault® C Anterior Cervical Discectomy and Fusion System (ACDF), and Vault® ALIF System; RTI’s Cequence Anterior Cervical Plate System and Unison®-C Anterior Cervical Fixation System; and Xtant’s Irix-A™ Lumbar Integrated Fusion System and Irix-C™ Cervical Integrated Fusion System.

The cases captioned as 1:18-cv-01972 (D. Del.), 1:18-cv-01973 (D. Del.), 1:18-cv-01974 (D. Del.), 1:18-cv-01975 (D. Del.), and 1:18-cv-01976 (D. Del.) remain pending.
