PTAB Institutes IPR on Claims of X-Ray Mammography Patent

September 6, 2018 – Fujifilm Corporation, Fujifilm Medical Systems USA, Inc., and Fujifilm Techno Products Co., Ltd. had filed a petition for inter partes review against Hologic Inc.’s patent.

On September 4, 2018, the PTAB instituted an IPR on Hologic’s patent after determining that the information presented in the Petition established a reasonable likelihood that Petitioner would prevail in showing that claims 6, 7, 9, and 10 are unpatentable for §103 obviousness. Since a decision to institute may not institute on less than all the claims challenged in the petition, the PTAB instituted the IPR of all challenged claims (claims 1, 4, 6-11) under all grounds set forth in the Petition.

The patent at issue is U.S. Patent No. 8,452,379, entitled “X-ray mammography with tomosynthesis.” The case is captioned FUJIFILM Corporation et al v. Hologic, Inc., Case No. IPR2018-00672.
