Court Construes Two Disputed Claim Phrases in Waste Management System Patent

May 29, 2018 – Plaintiffs Stryker Corporation and Stryker Sales Corporation filed a lawsuit for infringement of its waste management system patent against Defendant Poseidon Surgical, LLC. On May 24, the Court construed two phrases disputed by the parties: “said housing having: opposed proximal and distal ends” and “a longitudinal axis that extends between the proximal and distal ends and through the proximal section and the housing void space.”

The patent at issue is U.S. Patent No. 7,615,037 entitled “Removable inlet manifold for a medical/surgical waste collection system, the manifold including a driver for actuating a valve integral with the waste collection system.” The case is captioned Stryker Corporation et al v. Poseidon Surgical, LLC, Case No. 1-16-cv-01199, and is pending in the Western District of Michigan.
