Court Grants Summary Judgment on Infringement of Oxygen Generation Patents

March 20, 2018 – HVLPO2, LLC sued Oxygen Frog, LLC and Scott D. Fleischman for its patents relating to oxygen generation. On March 18, the court granted plaintiff’s motion for summary judgment that defendants infringed two of its oxygen generation patents based on the claim construction of the compressor. Since Defendant had admitted to using, providing, installing, and demonstrating the accused product, the court held that there is no genuine dispute that there was infringement.

The patents at issue are U.S. Patent Nos. 8,876,941, entitled “Method and Apparatus for Managing Oxygen Generating System,” and 9,372,488 entitled “Method and Apparatus for Managing Oxygen Generating System.” The case is captioned HVLPO2, LLC v. Oxygen Frog, LLC et al., Case No. 4-16-cv-00336.
