On March 16, 2018, Illumina, Inc. (“Petitioner”) filed a Petition to the USPTO’s Patent Trial and Appeal Board (“Board”) for an inter partes review of claims 1 and 2 of U.S. Patent No. 9,868,985 (“the ‘985 Patent”). The ‘985 Patent is owned by The Trustees of Columbia University and is drawn to a method for sequencing a nucleic acid by detecting the identity of a nucleotide analogue. In the Petition, Petitioner alleges that claims 1 and 2 are obvious under 35 U.S.C. § 103 over various patent documents and non-patent literature. The inter partes review remains pending at the Board and is captioned IPR2018-00797.
